You enter and use this car park at your own risk. You accept that a contract exists between you and us on the terms and conditions listed below.

Your vehicle is parked with us solely at your own risk.

We are not liable to you or any person with you for any damage or theft of your motor vehicle, its accessories, contents or for any injury to customers except permitted by law from any activity in our parking facility.

The company accepts no responsibility for any damage or theft of your motor vehicle, its contents including luggage during the use of the car park or any economic loss or consequential economic loss associated with providing the customer transport to and from the airport or cruise terminals. This includes airline tickets. It is the customer’s responsibility to ensure they allow sufficient time to board their flight.

We are not liable for any loss, damage, theft of vehicle or its contents due to the transport or storage of your vehicle at another authorized parking location operated by the company or its suppliers whatever the cause of such loss except permitted by law.

You agree to indemnify us from any claim made against us as a consequence of the use of this car park by you & persons accompanying you.

We may deliver the vehicle to any person producing the prevailing Kingsford Smith Airport Parking vehicle claim document or such other evidence of ownership or authority or entitlement to take possession of the vehicle as we in our sole discretion deem satisfactory. We are not responsible if evidence of ownership or entitlement to receive the vehicle is produced by a person other than you.

We reserve the right to park your vehicle in the front of the building 48 hours prior to collection. The customer accepts that this area is accessible from the street and by the general public and does not have our standard security protection. We are not liable for any theft, loss or damage to any vehicle from this policy. If the customer disagrees with this policy and does not wish their car parked in front of the building they must notify us in written form or at the time of check in. The request must be documented in writing on the vehicle agreement form or tax invoice and signed by the customer.

At our sole discretion the customer accepts that the company may leave a car parked in the front of our main building for the convenience of late night pickup with car keys provided in a key safe located at the front of the building. We notify customers by phone or sms that their vehicle is parked in front of the building. This occurs due to late flights and is done at the sole discretion of the company for the convenience of the customer. No claim will be made against the company or its insurance company for loss or theft of a vehicle parked under this policy. If the customer disagrees with this policy and does not wish their car left in front of our main building for late night collection they must notify us in written form or at the time of check in. The request must be documented in writing on the vehicle claim form or tax invoice and signed by the customer and our employee.

No employee, agent or contractor for us has authority to accept any goods for safe custody and will not be liable in any case for any loss or damage to any article left with us or any agent, employee or contractor for safe custody regardless of how the loss or damage is caused.

A parking fee is payable each time a vehicle enters or parking facility. If you bring a vehicle into this car park you agree to pay the parking fee as set by us from time to time published on our website. Fees are GST inclusive. Late fees are charged per day at $8 for outdoor or $10 for undercover commencing from the day the vehicle parking expired.

We have a general lien over, and the right to retain your vehicle as security for any money owed us. If you fail to pay any money you owe us, we may sell your vehicle after 120 days and recover any outstanding monies. We may sell your vehicle in such a manner as we deem suitable and at our absolute discretion and we are not obliged to obtain the best sale price for the vehicle.

Parking refunds are provided in extreme hardship cases and at the discretion of management. No refunds are provided 72 hours to a booking commencing and no part refunds once a booking commences. A refund fee of $20 applies to all bookings. Cancellation must be made by email or in writing.

A security call out fee or $250 is payable by a customer whenever our security company, additional staff or police are requested to attend our premises. This request may be due to any act of aggression either, verbal or physical by a customer against any employee. It may also include any threatening or intimidatory acts or failure of a customer to leave the premises when requested by an employee. No vehicle will be provided to any customer until the security call out fee is paid in full. We park your vehicles so that they are ready when your flight arrives. If you require your vehicle earlier than the return date we require 24 hours notice, if not no responsibility is accepted for the prompt return of the vehicle and a logistics fee of $20 may be charged at the discretion of management.

Vehicles may not be undercover on the day of your arrival, return, or when the yard is being organized. Cars are valet parked and may be driven on public roads or parked in public areas or driven to other parking stations operated by us. The customer has requested we valet park their car in our car park(s) and we are not liable for any damaged caused to your vehicle if it is moved or parked. Your own insurance covers the vehicle in these circumstances as you have authorized us to valet park the vehicle.

The customer has read and agrees to the terms and conditions relating to the parking and custody of vehicles parked with Econobirt Pty Ltd (ABN 97093011600) trading as Kingsford Smith Parking. Copies of which is available on our website, upon request from staff and displayed in our office and on the entry to the car park.

Standard opening hours of the business being 4.00 am to 12.00 midnight, which may change from time to time.

These conditions may only be altered only by a written agreement between you and us.

If any of these conditions are illegal or unenforceable the offending part is to be disregarded and does not affect the remaining part. Exclusion of our liability in these conditions is subject to any law, which restricts or forbids that exclusion of liability including the Competition and Consumer Act 2010.

In these conditions references to: “we”, “us” and “our” mean Econobirt Pty Ltd (ABN 97093011600) trading as Kingsford Smith Parking, “authorised parking facility” means a any parking facility operated by Kingsford Smith Parking used to park cars on behalf of our customers.
